Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Voice Call Service ("we," "us," "our," or "Company") governing your use of our AI-powered answering service, website, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Description of Service

Voice Call Service provides an AI-powered phone answering service that:

  • Answers incoming calls on behalf of your business 24/7/365
  • Qualifies leads and captures caller information
  • Books appointments and schedules meetings
  • Sends SMS/text message notifications and follow-ups
  • Integrates with your existing CRM and calendar systems
  • Provides call recordings, transcripts, and analytics

Account Registration

To use the Service, you must:

  • Be at least 18 years of age
  • Provide accurate, current, and complete registration information
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized account access

We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.

Subscription and Payment

Pricing

Our Service is offered on a subscription basis at $199 per month. Pricing is subject to change with 30 days' notice to existing subscribers.

Billing

  • Subscriptions are billed monthly in advance
  • Payment is due on the same date each month as your initial subscription
  • All fees are non-refundable except as expressly stated in these Terms
  • You authorize us to charge your payment method for all applicable fees

Cancellation

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of your current billing period
  • No refunds are provided for partial billing periods
  • Upon cancellation, your access to the Service will terminate at the end of the billing period

SMS/Text Messaging Terms

Important SMS Information

By using our Service, you may receive SMS/text messages. Please read this section carefully.

Types of SMS Communications

Voice Call Service may send or facilitate the following types of text messages:

  • Transactional Messages: Account alerts, appointment confirmations, service notifications, and other non-promotional communications related to your use of the Service.
  • Marketing Messages: Promotional offers, newsletters, and marketing communications (only with your express consent).
  • Customer Communications: Messages sent to your customers on your behalf through our platform.

SMS Consent

  • By providing your phone number and checking the SMS consent checkbox, you consent to receive text messages from Voice Call Service.
  • Consent for transactional messages is separate from consent for marketing messages.
  • SMS consent is not required to purchase our services.
  • Message frequency varies based on your service usage.
  • Message and data rates may apply. Contact your wireless carrier for details.

Opting Out

  • Reply STOP to any text message to unsubscribe at any time
  • Reply HELP for assistance
  • Contact support@voicecallservice.com to manage preferences

SMS Data Privacy

We do not sell, rent, or share your phone number or SMS consent data with third parties for marketing purposes. Your phone number and SMS opt-in information is used solely to deliver the services you requested and will not be shared with third parties except SMS service providers necessary to deliver messages.

Your Responsibilities for Customer SMS

If you use our Service to send SMS messages to your customers, you agree to:

  • Obtain proper written consent before sending any text messages
  • Provide clear opt-out instructions in all messages
  • Honor opt-out requests immediately
  • Comply with all applicable SMS laws including the Telephone Consumer Protection Act (TCPA)
  • Not send spam, prohibited content, or messages to numbers on do-not-call lists
  • Indemnify us against any claims arising from your SMS communications

Call Recording Consent

Our Service records and processes phone calls to provide AI-powered answering capabilities. By using the Service:

  • You acknowledge and consent to call recording and AI processing
  • You are responsible for providing appropriate call recording disclosures to callers as required by applicable laws (some states require all-party consent)
  • You authorize us to use call recordings to provide and improve the Service
  • Call recordings may be retained for quality assurance and service improvement

Important Notice

You are responsible for complying with call recording laws in your jurisdiction. Some states require all parties to consent to recording. We recommend consulting with legal counsel regarding your disclosure obligations.

Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Send unsolicited communications (spam) or make robocalls
  • Engage in fraudulent, deceptive, or misleading practices
  • Harass, abuse, or harm others
  • Impersonate any person or entity
  • Transmit malware, viruses, or harmful code
  • Interfere with the Service or circumvent security measures
  • Use the Service for illegal telemarketing or debt collection harassment
  • Violate the Telephone Consumer Protection Act (TCPA) or similar laws
  • Send messages containing prohibited content (adult content, illegal substances, etc.)

Violation of these terms may result in immediate suspension or termination of your account.

Intellectual Property

Our Intellectual Property

The Service, including all software, content, designs, logos, and documentation, is owned by Voice Call Service and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Your Content

You retain ownership of content you provide through the Service (business information, scripts, customer data). By using the Service, you grant us a limited license to use this content solely to provide the Service to you.

Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by us without obligation to you.

Confidentiality

We will treat your business information, call data, and customer information as confidential and will not disclose it to third parties except:

  • As necessary to provide the Service (e.g., to our service providers)
  • With your consent
  • As required by law or legal process
  • To protect our rights or the safety of others

Third-Party Integrations

The Service may integrate with third-party applications (CRMs, calendars, etc.). Your use of these integrations is subject to the third party's terms of service. We are not responsible for third-party services and do not guarantee their availability or performance.

Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (with advance notice when possible)
  • Emergency repairs
  • Factors beyond our control (internet outages, carrier issues, etc.)

We are not liable for any damages resulting from Service unavailability.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

We do not warrant that:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • AI responses will be accurate or appropriate for all situations
  • Any errors will be corrected

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOICE CALL SERVICE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or goodwill
  • Service interruption
  • Damages arising from missed calls or messages
  • Damages arising from AI errors or inaccuracies

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless Voice Call Service and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any laws or third-party rights
  • SMS messages sent through the Service on your behalf
  • Claims by your customers or callers

Termination

We may suspend or terminate your account immediately if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • Your use poses a risk to us or other users
  • We are required to do so by law

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.

Modifications to Terms

We may modify these Terms at any time by posting the updated Terms on our website. Material changes will be communicated via email or through the Service with at least 30 days' notice. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in Los Angeles County, California, in accordance with the rules of the American Arbitration Association.

You agree to waive any right to participate in class action lawsuits or class-wide arbitration against Voice Call Service.

General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Voice Call Service.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Waiver: Failure to enforce any right does not waive that right.
  • Assignment: You may not assign these Terms. We may assign them in connection with a merger or acquisition.
  • Force Majeure: We are not liable for delays or failures due to circumstances beyond our control.
